Reviewing Restrictions
There are private restrictions like deed restrictions and public restrictions like city zoning.
How do they relate? City zoning sets a minimum while a homeowner's assocation (HOA) may impose more stringent requirements (but they can't be less stringent than the city zoning). For example, the city zoning may have a requirement for a side or rear yard but it doesn't set rules around what to plant. The HOA may, however, have a list of trees and plants acceptable.
It is critical to understand the rules that govern your property so be sure to get a copy of restrictions and have the buyer sign off on having received them.
